Speaker: Professor Daniel Halberstam, University of Michigan

Biography: Daniel Halberstam is the Eric Stein Collegiate Professor of Law and Director of European Legal Studies at the University of Michigan.

Abstract: This paper begins by addressing the conceptual confusion in the debate surrounding the existence and scope of the ‘principle of national procedural autonomy’ in European Union law. After establishing the proper normative contours of such a principle, and teasing out the hidden elements that currently comprise its application, the paper proceeds to consider litigation surrounding race equality in Europe — in particular, the failure of Member State courts to provide proper remedies to end segregation of Roma in public schools.
