Abstract: The paper argues that ‘general principles’ are a regulated doctrinal category in EU law, and thus its judicial and other normative uses are constrained by EU law doctrine. The paper argues that legal scholarship is the main culprit in diluting the doctrinal understanding of general principles, which has created a permissible environment for the Court of Justice of the EU to exploit the general principle trope in its reasoning. The paper offers a reflection on the doctrinal, and therefore legal, constraints under which the Court and other actors making prescriptive propositions about EU law operate in this area and examines examples of judgments that do not respect these constraints.
