Abstract: A buyer with monopsony or superior bargaining power may exploit a seller by demanding an excessively low price for its purchases. Exploitation may also take the form of non-price trade terms, such as where a powerful buyer charges for its retail services or shifts the risk of unsold or damaged goods to the seller, which are common practices in the grocery industry. This presentation reflects on whether traditional competition law principles are an adequate response to these problems, and how they might be refined or reformed to provide more comprehensive solutions.
